Preamble

The online sales site https://barsac-sauternes.com/ has been set up by the company XXXXXXXXXXXXXXXXX – under the name of La Boutique du Château Liot – whose registered office is xxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxxx. The purchase of a product on this site commits the customer to the acceptance of the general conditions of sale. Consequently, the present general conditions of sale do not require the handwritten signature of the customer.

  1. Scope of the General Terms and Conditions of Sale

These general conditions of sale (hereinafter referred to as the “GCS”) express the entirety of the obligations of the parties. In this sense, the consumer is deemed to accept without reservation the entirety of the provisions of these general conditions of sale. Château Liot undertakes to respect its role as a retailer within the framework of these conditions. The present terms and conditions may be modified and/or updated. The terms and conditions applicable to an order are those in effect on the day of the order. The purpose of these GCS is to specify the rights and obligations of the parties in the context of the online sale of goods and services offered by Le Château Liot to the customer. They constitute the contractual framework of the sale with the order form, the confirmation e-mails, the automatic recording systems used by the site and the invoice.

  1. Acceptance and validation of the Order

The automatic recording systems are considered as valid proof, of the nature, content and date of the order. The ordering process consists of validating a shopping cart by clicking on the “CART” button. A summary screen of the order is then proposed to the customer who must confirm his delivery address and know the shipping costs (Shipping only in France) then click on “Validate the Order”.

The customer is then directed to a summary page of his order, the customer must indicate his address of Invoicing and delivery or a delivery address other than that of the invoicing, the total amount Products + Shipping costs, it indicates are means of payment, then click on “ORDER” having validated the T&C.

The order is final only after full payment of the price. Failure to comply with the various stages of the ordering process will result in the invalidity of the order and its rejection. The information stated by the buyer when taking the order is binding on the buyer: in case of error in the wording of the recipient’s details, Le Château Liot cannot be held responsible for the impossibility in which it could be to deliver the product.

This step constitutes the irrevocable acceptance of the customer which can only be questioned in the cases restrictively provided for in these general terms of sale such as “right of withdrawal” and “out of stock”.

  1. Availability of Products

Orders will be accepted within the limits of available stocks. To this end, the customer is informed at the time of ordering on the information page of the site describing each item of the availability of the said item. The offers contained on this site are valid as long as the products remain online and while stocks last. Château Liot cannot be held responsible for the non-execution of the contract in case of stock shortage or unavailability of the product, force majeure, disruption or total or partial strike of postal services and means of transport and/or communications, flood, fire… The order will be executed at the latest within 30 days from the day following the one when the order was definitively confirmed.

  1. Product Information

All products are described on the site in each product sheet. The photographs, videos and drawings illustrating the products presented are a reproduction that is intended to be as accurate as possible, but they do not have any contractual value. The characteristics of each product are available on the corresponding data sheet if available.

The customer is invited to read them before placing an order.

Château Liot cannot be held responsible for any non-substantial errors that may affect the description and presentation of the products, their components, accessories or materials.

The Château Liot guarantees the buyer, with regard to hidden defects that may affect the delivered products, within the framework of a replacement of the defective products, or their reimbursement without being able to be considered by the buyer as responsible for the possible harmful consequences that these hidden defects could have caused. The products supplied by the Seller benefit from the legal guarantee in accordance with article L211-4 of the French Consumer Code.

  1. Prices & Rates

The prices are indicated in euros and are applicable only on the date of the sending of validation of the order by the customer. The price indicated on the product sheets does not include transport. The price indicated in the confirmation of order is the final price, expressed all taxes included and including the V.A.T for France and the countries of the European Union. This price includes the price of the products, the packing and the transport costs. The totality of the payment must be realized at the time of the order. The customer is solely responsible for verifying the possibility of importing the products ordered with regard to the laws of the country of delivery.

  1. Method of payment

The price of the products is payable in cash on the day of the effective order. The payment is made by debiting your credit card: Visa, Mastercard or your PayPal account.

The customer guarantees Le Château Liot that he has the necessary authorizations to use the method of payment chosen by him, during the validation of the order form. Le Château Liot reserves the right to suspend any order and any delivery in case of refusal to authorize payment by credit card from the officially accredited organizations or in case of non-payment. Château Liot reserves the right to refuse any order from a customer with whom there is a dispute. The Château Liot retains full ownership of the products sold until full payment of all sums due by the customer in the context of his order, including fees and taxes.

The transfer of ownership of a good purchased from Château Liot by the customer to a third party will not be taken in charge by Château Liot. Only the original purchaser of this good can claim access to the clauses of the present GCS.

  1. Terms of delivery

The products are delivered, sent by the Post office or carrier to the address indicated by the customer at the time of the order. The delivery is considered to be made as soon as the product is handed over to the carrier. The customer must verify the completeness and the conformity of the information he provides to Château Liot. Château Liot cannot be held responsible for any typing errors and the consequences in terms of delay or delivery error. In this context, all costs incurred for the reshipment of the order will be entirely at the customer’s expense. For deliveries outside of metropolitan France, the customer agrees to pay all taxes due for the import of products, customs duties, Value Added Tax (VAT) and all other taxes due under the laws of the country where the order is received. The Château Liot is released from any legal responsibility if the payment of the taxes was not carried out by the customer. Château Liot cannot be held responsible for delays in delivery due to errors or disruptions attributable to carriers (total or partial strike of postal services and means of transport and/or communications). The consumer is required to check the condition of the packaging of the goods upon delivery and to report any damage to the carrier on the delivery slip, as well as to Le Château Liot, within 3 days of receipt of the package.   1. Delivery problem due to the carrier

Any anomaly concerning the delivery (damage, missing product compared to the delivery order, damaged package, broken products…) must be imperatively indicated on the delivery order in the form of “handwritten reserves”, accompanied by the signature of the customer. In the case of a shipment made by the Post Office, if the package arrives open or damaged (especially with the presence of the yellow tape “the post office”) it is essential that the customer has the letter carrier or the Post Office establish a “spoliation report” (report 170) so that Le Château Liot can open an investigation and a compensation procedure. The customer must also confirm this anomaly by sending a registered letter with acknowledgement of receipt to the carrier within two working days following the date of delivery. The customer must simultaneously send a copy of this letter (with the original “spoliation report” if applicable) by mail to : Le Château Liot, xxxxxxxxxxxxxxxxx xxxxxxxx. Any claim received after the deadline will be rejected.

  1. Delivery error – Non-conforming products

The consumer will have to formulate with the Château Liot. He has a period of 7 days from the delivery, any claim of error of delivery and / or non-conformity of the products in kind or in quality compared to the indications on the order form. Any claim made after this period will be rejected without possibility of appeal. Any complaint not carried out in the rules defined above and within the time limits could not be taken into account and will release the Château Liot from any responsibility towards the consumer.   1. Right of withdrawal

The customer has, within 14 working days from the delivery of his order, a right to return, at his own expense, for exchange or refund, products that do not suit him in accordance with Article L121-16 of the Consumer Code. In all cases, the return is made at the consumer’s risk. Château Liot recommends that the consumer return the products by colissimo with a recommendation or additional insurance guaranteeing, if necessary, the compensation of the products up to their real market value in case of spoliation or loss of the goods. The returned product must be in its original condition and packaging. It must not have been used, nor have suffered any deterioration, however slight, and be in a state of perfect cleanliness. This right of withdrawal is exercised without penalty, with the exception of the return costs which remain the responsibility of the customer. Within a maximum period of 30 days from the receipt of the returned product, the customer will be reimbursed for the sums paid. For this purpose, he will communicate to Château Liot his bank details.

  1. Reservation of ownership

By derogation to the provisions of article 1583 of the Civil Code, it is agreed with the customer that the transfer of ownership of the products sold by Le Château Liot is suspended until full payment of their price. If the client fails to pay a fraction of the price on one of the agreed upon dates, the sale will be terminated by right if Le Château Liot so wishes. Le Château Liot reserves the right to proceed or to have proceeded by any agent designated for this purpose after sending to the customer a registered letter with acknowledgment of receipt to the recovery of the unpaid products without prejudice to any other recourse. Notwithstanding any clause to the contrary, the present retention of title clause is enforceable against the customer as well as against other creditors in accordance with the provisions of article L621-122 paragraph 2 of the Commercial Code.

The present general conditions are subject to French law. This is the case for the rules of substance as for the rules of form. In the event of a dispute or claim, the consumer should first contact Château Liot to obtain an amicable solution.

  1. Data processing and liberties

In accordance with the Data-processing law and Freedoms on January 6, 1978, you have a right of access, of correction, modification and suppression concerning the data which concern you.
